This Privacy Policy explains how ArtCubbies LLC ("ArtCubbies," "we," "us," or "our") collects, uses, and discloses information about you and your children's artwork when you use our website and application at app.artcubbies.com and related products and services (collectively, the "Services").
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top and, in some cases, by providing additional notice (such as a statement on our homepage or an email). We encourage you to review this policy whenever you use the Services.
A Note on Children's Artwork
ArtCubbies exists to help adults archive and share their children's artwork. The information you upload, such as photographs of artwork and details like a child's name, age, and the dates and titles of their work, often relates to children, even though our users are adults. We treat this information with particular care, and this policy describes what we do with it.
ArtCubbies is intended for use by adults (18 or older). The Services are not directed to children, and children are not permitted to create accounts or use the Services directly. By creating an account, you represent that you are at least 18 years old.
Collection of Information
Information You Provide to Us
We collect information you provide directly, including when you create an account, upload artwork, organize it into cubbies and compilations, invite household members, purchase any paid products or services we may offer, or contact us for support. This includes:
- Account information: your name and email address, and account credentials.
- Content you upload and create: photographs of your children's artwork, and information you add or edit such as a child's name, a child's age or birthdate, cubby and compilation names, dates, titles, tags, and favorites.
- Household and invitation information: the email addresses of people you invite to your household and the access you grant them.
- Payment information: if you purchase any paid products or services we may offer, payment is processed by our third-party payment processor.
- Communications: information you provide when you contact us.
Information Generated Automatically From Your Content
When you upload a photo of artwork, our Services automatically generate additional information about it using an AI vision model:
- AI-generated titles and tags: we send the uploaded image to a third-party AI model (see "Service Providers" below) which returns a suggested title and descriptive tags. These titles frequently incorporate names or text that appear in the artwork itself, and may therefore contain your child's name or other text the model reads from the image. Titles and tags are generated automatically and are not reviewed by us for accuracy before they appear. They may be inaccurate or may misattribute a piece. You can edit or remove them.
- Derived image versions: we generate resized and enhanced versions of your images for display and for any products or services we may offer.
- Internal signals: we may generate internal signals about an image (for example, an estimate of whether a photo appears to be artwork, or text detected in an image). Some of these internal signals are used only to operate the Services and are not shown to you or included when you export your data.
Information We Collect Automatically When You Use the Services
- Log and usage information: we log information about your use of the Services, which may include access times, pages or screens viewed, and actions taken. We use an in-product events record to understand how features are used; this record is designed to exclude the personal content of your artwork (such as titles containing names).
- Device information: we may collect information about the device you use, such as device type, operating system, and browser.
- Cookies and similar technologies: we use cookies and similar technologies to keep you signed in and to operate and improve the Services. See "Your Privacy Choices and Rights" below.
We do not currently collect precise geolocation from your device.
Use of Information
We use the information described above to:
- provide, maintain, and improve the Services, including storing your artwork and generating suggested titles and tags;
- display your household's content to you and to the members you invite, according to the access you grant;
- process and deliver any purchases, and send you related confirmations;
- send you technical notices, security alerts, and support and administrative messages;
- respond to your questions and provide customer support;
- monitor and analyze usage and trends to improve the Services;
- run an automated safety and quality review of AI-generated titles and tags (see "Safety" below); and
- protect the security and integrity of the Services and comply with law.
ArtCubbies is based in the United States, and the information we collect is governed by U.S. law. By using the Services, you consent to the processing and transfer of information in and to the United States.
How AI Is Used, and What Is Not Done With Your Content
Because trust matters here, we want to be specific:
- We send your uploaded images to a third-party AI model to generate titles and tags. Our agreement with that provider (Anthropic) provides that content sent to the model is not used to train the provider's models, is not sold, and is not shared, and is subject to a limited retention window (currently 30 days) under a data-processing agreement.
- The AI generates text about your images (titles and tags). It does not create new or altered artwork from your children's originals.
- We do not sell your personal information or your children's artwork, and we do not share your children's artwork with third parties except the service providers described below who process it to operate the Services. We do not use your children's artwork to train the AI models of Anthropic or any other third-party AI provider. We may use information about how you use the Services, including adjustments you make to automated suggestions such as how you crop or edit a piece, to improve and calibrate the Services' features. This is limited to improving our own product functionality; we do not use it to train third-party AI models, and we do not sell it.
Sharing of Information
We may share information as follows:
- With members you invite. The core function of ArtCubbies is to let you share your household's content with family members you invite. What each member can see and do depends on the access the account owner grants.
- With service providers. We share information with vendors who process it on our behalf to operate the Services. See "Service Providers" below.
- When you share or export. If you use a sharing feature (for example, sharing an image through your device's share menu) or export your archive, that content leaves our Services at your direction and is then handled by you and whatever destination you choose.
- For legal reasons. We may disclose information if we believe it is required by law, regulation, or legal process, or necessary to protect the rights, property, or safety of ArtCubbies, our users, or others, including to report apparent child sexual abuse material as required by law.
- In a business transfer. We may share information in connection with a merger, financing, acquisition, or sale of assets.
- With your consent or at your direction.
We may also share aggregated or de-identified information that cannot reasonably be used to identify you or your children.
Service Providers (Sub-processors)
We rely on the following third-party providers to operate the Services. Each processes information only as needed to provide its service to us:
- Anthropic — AI vision model that generates titles and tags from uploaded images (limited retention, under a data-processing agreement; content not used for training, not sold, not shared, per our agreement).
- Neon — database hosting.
- Cloudflare R2 — image storage.
- Vercel — application hosting and website traffic analytics.
- Resend — transactional email (such as invitations and account notices).
- Stripe — payment processing for purchases.
Sharing With Family Members and Friends
ArtCubbies content is associated with the account of the person who created it (the "account owner"). The account owner may invite other people to view or interact with their content, and it is entirely at the account owner's discretion whom to invite and what access to grant. The account owner is responsible for those decisions and for managing access to their content.
An honest limitation: anyone you allow to view an image can, in practice, capture what they see on their screen (for example, by taking a screenshot or saving an image their browser has loaded). While we apply technical restrictions to limit what invited members can do with your content, we cannot prevent someone who can see an image from making a copy of what is on their screen. Please keep this in mind when deciding whom to invite and what access to grant.
Safety
ArtCubbies is a service for adults archiving their own children's artwork. We take a layered, proportionate approach rather than proactively reviewing everything you upload:
- We do not proactively monitor or review all uploaded images. Your artwork is private to your household and the members you invite.
- Automated review of generated metadata. As part of the AI processing that generates titles and tags, our system can flag content that does not appear to be artwork or that appears inappropriate. We also run an automated review of the AI-generated titles and tags for safety and quality. These are automated checks, not human moderation of every image.
- Prohibited content. Our Terms of Service prohibit unlawful, sexually explicit, exploitative, and non-artwork content. We reserve the right to remove such content and to suspend accounts.
- Reporting illegal content. If we obtain knowledge of apparent child sexual abuse material (CSAM) or child exploitation, through an automated flag, a report, or otherwise, we will restrict access to it, report it to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law, and preserve the content and related records for as long as the law requires. This may mean we retain specific content that has been flagged and reported even if you request its deletion, where the law requires us to preserve it.
Security
We take reasonable measures to help protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction.
Deleting Your Content and Your Account
Within the Services, you can remove individual pieces, which takes them out of your active view.
To permanently delete specific content or your entire account and its content, contact us at hello@artcubbies.com. We will permanently remove the associated images and information from our active systems within 30 days of verifying your request.
Two limits apply to permanent deletion, both standard:
- Backups. Copies may remain in routine encrypted backups for a limited period before those backups are overwritten in the normal course.
- Legal retention. We may need to retain specific content or records where the law requires it, for example content that has been flagged and reported to authorities under the child-safety obligations described above, which we are legally required to preserve. Such content is retained only for the required purpose and period.
Your Privacy Choices and Rights
Depending on where you live, you may have rights under your state's privacy laws to access, correct, or delete the personal information we hold about you, or to request a copy of it. Regardless of your location, we extend the following choices to all our users:
- Access and portability: you can request a copy of the personal information associated with your account, and full members can export their household's content at any time.
- Correction: you can update your account information, or contact us to correct information we hold.
- Deletion: you can request deletion of your content or your account as described in the "Deleting Your Content and Your Account" section above.
To exercise any of these, contact us at hello@artcubbies.com. We will respond consistent with applicable law. We do not sell your personal information or your children's artwork, and we do not use it for targeted advertising.
Cookies
Most browsers accept cookies by default; you can usually set your browser to remove or reject them. If you do, some features of the Services may not function properly.
Promotional Communications
You may opt out of promotional emails from ArtCubbies by following the instructions in those emails. If you opt out, we may still send non-promotional messages, such as those about your account.
